Rate, Fee and Other Cost Information | Annual Percentage Rate (APR) for purchases | Standard Purchase APR: Wachovia Visa Business without Rewards: 5.24% to 9.24% variable.a Wachovia Visa Business with Rewards: 7.24% to 11.24% variable.a Your Standard Purchase APR will be assigned at Account Opening and will be determined by our review of your application and your credit history. | Other APRs | Promotional Balance Transfer APR: A 0% fixed APR for 12 months from the Account Opening Date ("Account Opening") on balance transfer transactions; thereafter, your variable Standard Purchase Rate applies to any outstanding balance. Currency Exchange fee: 3% of the U.S. dollar amount of the transaction whether or not a foreign currency is converted.
Quasi-Cash fee (purchase of money orders, travelers checks, foreign currency, lottery tickets, gambling chips): 3% of the transaction amount ($10 minimum).
Wire Transfer fee: 3% of the transaction amount ($10 minimum). | Rates, fees, and terms may change: We may change the account terms, including the APRs or fees, at any time for any reason. If we change the terms of your account, you will receive advance notice and have a right to opt out in accordance with applicable law. All account terms are governed by your Cardmember Agreement and Disclosure Statement and Supplement that accompany your card. Terms of your account are not guaranteed for any period of time. We may change terms based on market conditions, business strategies, information contained in your credit report or for any other reason. a Variable rates are based on the Prime Rate. The Prime Rate (“Prime”) is the highest Prime Rate published in the “Money Rates” section of the Eastern edition of The Wall Street Journal as of the 25th date of the previous month ("Index Date"). In the event that a rate is not published on the 25th of the month, the rate published most recently prior to that date will be the effective rate. Prime Rate changes will take effect on the first day of the billing cycle that begins on or after the first day of the month following the Index Date. Disclosed variable rates and fees were accurate and based on the Prime Rate of 3.25% in effect as of December 26, 2008 and may have changed. b Convenience Checks will only be issued to the primary account holder. Authorized Users on the Wachovia Visa Business card account are not permitted to negotiate convenience checks. The first three Welcome Kit checks may be used to access funds up to the credit limit. Non-promotional convenience checks may only access up to 50% of the credit limit. c We may, without prior notice, terminate your participation in any Promotional Plan if the Total Minimum Payment Due is not received by the Payment Due Date two (2) times during the promotional or introductory period. Any remaining promotional balance will be subject to your Standard Annual Percentage Rate for Purchases for the duration of the promotional period. See footnote "d" for additional information related to the loss of promotional rates. d If you fail to make the Minimum Payment Due by the Due Date shown on your monthly statement for two (2) consecutive billing cycles, or if you fail to make the Minimum Payment Due, by the Payment Due Date, three (3) times during a rolling consecutive twelve (12) month period, we may automatically increase any and all of your APRs (including promotional APRs) to the Default APR. Each increase will be effective as of the first day of the next billing cycle. The Default APR will not decrease below 25.99%, regardless of the changes to Prime Rate. The Default Rate will remain in effect until six (6) consecutive on-time Total Minimum Payments are received, after which your account will be considered for further review. The Default Rate in effect at that time may revert to your Standard APR for Purchases and Cash Advances, subject to recent changes in your credit history. See Cardmember Agreement for further details. e The number of days between your statement Closing Date and your Payment Due Date (the grace period) may vary from one billing cycle to another. There is no Finance Charge on new purchases made in a billing period if: 1) you pay the total previous Balance (as shown on the monthly statement) in full by the Payment Due Date; or 2) the previous Balance was zero or a credit balance. There is no period within which you can avoid periodic Finance Charges on Cash Advances or Transaction Fees. | Authorizations | By signing and returning the application to Wachovia Bank, N.A. ("We," "Us," "Our"), the Authorized Signer and the Business (collectively "You") hereby agree to the following:
1. You are applying for a Wachovia Visa Business card account with us; and, if an account is opened we will issue a credit card on the account to the Authorized Signer, whose signature appears on the Application/Acceptance Form and to all "Authorized Users" for whom additional cards are requested. 2. You authorize us to obtain credit reports (on Authorized Signer and the Business) in connection with your request for an account. If an account is opened, we may also obtain credit reports in connection with additional extensions of credit, upgrade of the product or change in terms; the renewal, review or collection of your account; or in connection with another legitimate purpose. 3. You agree that we may contact you at any email address or telephone number (including mobile, cellular, or similar devices) you specify in this application and you consent to their use by Wachovia and its affiliates or service providers for all purposes relating to this account, including but not limited to servicing and collection by or on behalf of Wachovia, and email messages to your email address and calls made via an autodialer or artificial prerecorded message. 4. If an account is opened, you will receive a Cardmember Agreement with your card(s). All terms and conditions of your account are contained in your Cardmember Agreement and Disclosure Statement and the Cardmember Agreement and Disclosure Statement Supplement. You agree to these terms by using your account or by not closing the account within three (3) days of receiving the Cardmember Agreement. 5. The Authorized Signer and the Business will be individually, jointly and severally liable for all transactions made with the card and convenience checks on the account and for all charges to the card(s) issued to Authorized Users. 6. You authorize us to apply your payments and credits to balances with lower APRs (such as purchases) before balances with higher APRs (such as cash advances). 7. You certify that: a) that you (including each Authorized User) are of age to legally contract (minimum 18 years of age); you are either a U.S. citizen or permanent U.S. resident; you have a valid tax payer identification number and/or social security number, as applicable; b) each Authorized User is duly employed by the Business as of the date a card is requested for such Authorized User; and, c) that you have read and reviewed all terms, conditions and disclosures provided. You certify that the information you provide in connection with obtaining this credit card is complete and accurate. You understand that omission of information requested may be reason for denial. 8. Our agreement with you will be governed by North Carolina and applicable Federal laws. Claims and disputes will be subject to arbitration. 9. To take advantage of this offer you must meet our credit qualification criteria. Your initial credit limit will be determined by a review of your application, your credit history and your ability to repay. If you are approved, your Business credit limit will be at least $2,500, and your Account Opening documentation, including credit card plastic, will not be mailed outside of the U.S. 10. Your account (including all cards and convenience checks) will be not used for consumer purposes (personal, family or household use). | Balance Transfers | Total transfer requests cannot exceed the available credit limit. Wachovia will process your Balance Transfer requests in the order you specify. It can take approximately six (6) weeks to process your request. You should continue to make payment to each creditor until the transfer appears on your statement. Finance Charges will begin on the date the balance transfer posts to your Wachovia account. If you have a dispute with a creditor and pay that disputed balance with a transfer from your new Wachovia Visa Business card, you may lose certain dispute rights. | Wachovia Possibilities Rewards® | This is an abbreviated summary. If you are approved and accept a Wachovia Visa Business with Rewards Credit Card account, you will be automatically enrolled in the Wachovia Possibilities Rewards Program (“Program”). All cards issued in association with this credit card account will earn points towards the same Program Rewards Account. Points will be earned based on net dollars of purchases at a rate of four (4) points per dollar for Wachovia Visa Business with Rewards. Please allow up to eight (8) weeks for points for transactions made outside the U.S. or through non-electronic means to appear in your Rewards Account. Balance transfers, cash advances, purchases of money orders or other cash equivalents, use of Convenience Checks, and fees or finance charges do not earn points. There is no cap on the number of points that may be earned in a calendar year. Points expire after five (5) years. Points may be redeemed for travel or merchandise certificates and gift cards, which may be redeemed with participating merchants.
